New EU competition rules on IP licensing

The current EU Technology Transfer Block Exemption Regulation is due to expire in 2014.  The Regulation provides a “safe harbour” from the competition law (antitrust law) prohibitions set out in Article 101 of the Treaty on the Functioning of the European Union.  The safe harbour applies to certain types of intellectual property agreement (mostly technology licences, but also certain assignments) that meet the detailed requirements of the Regulation.

The current Regulation is discussed in detail in our book, Technology Transfer (Bloomsbury, 3rd edition, 2010).

The European Commission has started a consultation exercise on what should replace the current Regulation when it expires.  Thanks to IP Draughts’ friend and former colleague, Susan Singleton, for alerting him to this development.  If you want to influence the European Commission, now may be the time to act!
